HOW DOES AN UNCONTESTED DIVORCE WORK?

If both parties agree that they want a divorce and agree to all issues, then they qualify for an uncontested divorce.  This means the parties agree who gets all property, including houses and furniture, who gets what automobiles, who get what bank accounts, who gets what pension plans, how much money each party gets for spousal support and child support, who the children live with, how much each party sees the children, and how much each party pays for attorney fees.   In addition, each party must be willing to sign paperwork outlining their agreement.

If the parties have come to an understanding, and your divorce will be filed anywhere within the state of California, we can process your divorce without you ever going to court.  In order to get started, you simply complete the secured Divorce Questionnaire page of this Web Site.  Famularo & Associates will then contact you to confirm receipt of the information and arrange for payment of your flat fee by check, money order or credit card.  A licensed attorney will interview you over the telephone and answer any legal questions you may have.

We shall then complete your pleadings for your signature and filing.  After the paperwork has been prepared, a filing fee will be due.  This is a first appearance fee which the court charges to cover the costs of the judge and his staff to process your case.

As soon as the initial paperwork has been processed by the court, you will receive a second packet of papers from us which must be signed by both you and your spouse, including a judgment which must be notarized by your spouse.  Depending upon the courthouse your case is filed in, the court will take between one to six months to process the final documents.  Once you receive these documents back from the court, your judgment will be final.

Even if you and your spouse agree to a divorce, and your judgment has been processed by the court, there is a six-month waiting period before you can remarry.  The six-months begins to run once the divorce has been filed and your spouse has been served with the papers.  When you receive your papers back from the court, it will state the date you become eligible to remarry.

The flat fee paid to Famularo & Associates shall cover all legal advice you need from a licensed attorney, preparation of all forms, filing of all forms, and any other work required to obtain a final, uncontested divorce judgment.  The fee does not include preparation of orders dividing pension plans (i.e. QDROS), preparation of documents transferring real property (i.e. quit-claim deeds, grant deeds, or interspousal transfer deeds), representation in connection with a contested divorce, appeals or any other post-judgment matters.

Should your divorce become contested at any time during the process, our retainer agreement is no longer valid and we can no longer represent you. Please note, the money you pay us is a flat fee and is not refundable once we begin work on your case.  Make sure that your spouse will cooperate with you prior to beginning the process!
